Rental Agreement & Liability Waiver

Version v1 · Effective May 2026

1. Equipment

Pagosa Trailer Rentals, LLC ("Owner") agrees to rent the trailer described in your booking confirmation (the "Equipment") to you (the "Renter"). The Equipment must be returned in the same condition received, normal wear and tear excepted.

2. Tow Vehicle Requirements

Renter's tow vehicle must be equipped with a functioning brake controller and a round pin (7-way RV blade) trailer plug. Owner cannot release the Equipment if these are not present or operational.

3. Security Deposit

A security deposit hold will be placed on your card at the time of booking. Provided the Equipment is returned undamaged and on time, the hold will be released within 7 days of return. Damage, late return, or excessive cleaning will be deducted from the deposit and any additional charges may be assessed.

4. Assumption of Risk & Liability Waiver

Renter acknowledges that operating a horse trailer involves inherent risks, including but not limited to road accidents, equipment failure, and injury to animals or persons. Renter assumes all such risks and releases Owner from any and all liability arising from use of the Equipment.

5. Insurance & Health Documentation

Renter must provide valid proof of auto and trailer insurance and current Coggins / health papers for every horse hauled at the time of pickup. We cannot release the trailer without these documents.

6. Cleaning & Equipment

Trailers must be returned power-washed clean, with floors and mats free of manure and debris. A $75 cleaning fee will be charged for trailers returned dirty. To skip this, select "Pre-Paid Cleaning" at checkout.

Every rental includes a manure fork and broom. A $50 replacement fee per item will be charged for any tools not returned with the trailer.

7. Cancellation

Cancellations more than 7 days before pickup receive a full refund. Cancellations within 7 days are not automatically refunded; the security deposit is always released if not yet held.

8. Governing Law

This agreement is governed by the laws of the State of Colorado.

By checking the waiver box and typing your full legal name at checkout you electronically sign and agree to the terms above. A countersigned PDF copy is emailed to you and available from My Bookings.
